Welcome to BUMS.AI ("we," "our," or "us") and our services including CookieSpy Visitor Tracker, SMART Websites, and the BUMS.AI Portal (collectively, the "Platform").
By accessing or using our Platform, you agree to be bound by these Terms and Conditions (the "Terms"). If you do not agree to these Terms, please do not use our Platform.
1. Acceptance of Terms
By using our Platform, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. You also agree to comply with all applicable laws and regulations.
2. Use of the Platform
Account Registration: You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.Prohibited Activities: You agree not to misuse the Platform, including but not limited to:Engaging in unlawful activitiesCircumventing security featuresUsing the Platform to harm others or violate their privacyAttempting to reverse engineer any aspect of our proprietary systems
3. Subscription and Payments
BUMS.AI offers various subscription plans. By purchasing a plan, you agree to pay the fees outlined at checkout. All payments are final and non-refundable unless otherwise required by law.You may cancel your subscription according to the terms of your specific plan, but access to the Platform will continue until the end of the billing cycle.
4. FREE Website Promotion Terms
The FREE Website promotion requires an 18-month commitment to BUMS.AI hosting services at $97/month.Early termination of hosting services prior to the completion of the 18-month term will require immediate payment of the remaining balance for the full 18-month period.Upon successful completion of the 18-month term, website hosting may be transferred to another GoHighLevel instance at your request.BUMS.AI will provide a standard transfer of website files, but we do not guarantee compatibility with other hosting environments.
5. Intellectual Property
All content, design, code, workflows, custom CSS wrappers, AI configurations, chatbots, automations, and other materials on the Platform are the proprietary property of BUMS.AI.You may not copy, distribute, modify, or use any part of the Platform or its proprietary systems outside of the BUMS.AI ecosystem without explicit written permission from BUMS.AI.The websites, webforms, chatbots, automation workflows, and other materials created by BUMS.AI remain the intellectual property of BUMS.AI even when deployed for your business.You are granted a limited license to use these materials while your subscription is active and in good standing.
6. Liability Disclaimer
The Platform is provided "as is" without warranties of any kind, either express or implied.We are not liable for any indirect, incidental, or consequential damages resulting from your use of the Platform.BUMS.AI does not guarantee specific business results from the use of our Platform, as results may vary based on your industry, business practices, and market conditions.
7. Privacy
Your use of the Platform is governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.
8. Termination
We reserve the right to suspend or terminate your access to the Platform if you violate these Terms or engage in fraudulent activity.Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
9. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions.Any disputes arising from these Terms will be resolved in the courts of Texas.
10. Modifications to Terms
BUMS.AI reserves the right to modify these Terms at any time. We will provide notice of significant changes.Your continued use of the Platform after changes to the Terms constitutes acceptance of the modified Terms.
