1. Acceptance of Terms

By accessing or using BUMS.AI ("Company", "we", "us", or "our") services—including our website(s), marketing systems, hosted portals, social media tools, or any other product—we assume you have read, understood, and agree to be bound by these Terms of Service ("Terms"), as well as all applicable laws and regulations. If you do not agree, you are not authorized to access or use our services.

2. Services Offered

BUMS.AI provides digital services including but not limited to:

Custom and template-based website creation
Lead generation tools and CRM access (Go HighLevel-based)
Digital marketing services (SEO, email, SMS, ads)
Social media content and scheduling
Workflow automation and backend systems

Free websites require a 12-month active subscription. Early cancellation before 12 months requires a $1,000 buyout fee to retain the website assets or transfer them to another provider.

3. Telephony Compliance (A2P 10DLC)

By using our platform's SMS and telephony features, you agree to abide by all applicable U.S. telecommunications laws and carrier compliance rules (including A2P 10DLC registration). Spam, deceptive practices, and unsolicited messaging are strictly prohibited. Users are responsible for maintaining opt-in records and compliance with all messaging rules.

We reserve the right to suspend or terminate your messaging privileges or account if violations are detected or if required by telecom carriers.

4. Stripe & Payment Policy

We process all payments via Stripe. By purchasing any service or subscription, you agree to:

Provide accurate billing information
Authorize recurring charges as applicable
Acknowledge that all Stripe fees are non-refundable
Accept our refund and cancellation policy (see Section 5)

If your payment fails or is disputed, your services may be paused until resolution.

5. Refund & Cancellation

Refunds are only available for services not delivered. Once a digital product (such as a website, design, marketing campaign, or setup) has been initiated or delivered, it is considered fulfilled and non-refundable.

Subscriptions may be canceled with 7 days' notice before the next billing cycle. If a free website was provided, you may:

Continue your subscription until the 12-month term ends, or
Pay the $1,000 buyout fee to retain rights to the site

6. Use License

You are granted a limited, non-exclusive, non-transferable license to access and use BUMS.AI materials solely for business purposes. You may not:

Modify or redistribute any materials without written permission
Use our services for illegal or unauthorized purposes
Reverse engineer, copy, or resell any technology or codebase
Share access credentials without authorization

Violation of these terms may result in immediate termination of access.

7. Disclaimers

All services are provided "as is." We do not guarantee specific business outcomes, increased revenue, or lead volume. No warranty is made regarding:

Platform uptime or speed
Results from marketing or CRM usage
Third-party services or integrations

8. Limitation of Liability

To the fullest extent permitted by law, BUMS.AI is not liable for any direct, indirect, incidental, or consequential damages—including lost profits, downtime, or data loss—arising from the use or inability to use our services.

9. Intellectual Property

All content, templates, graphics, code, and documentation provided by BUMS.AI are protected under U.S. copyright and trademark law. Client content remains the property of the client but may be used in promotional materials with permission.

10. External Links

BUMS.AI may include links to third-party websites. We are not responsible for the content, terms, or policies of any external site.

11. Modifications

We reserve the right to update these Terms at any time. Changes will be effective upon posting. Continued use of our services constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Texas, USA. Any disputes shall be handled in a court of competent jurisdiction within Texas.
